"حق اللجوء" بين الإعلان العالمي لحقوق الإنسان والميثاق العربي لحقوق الإنسان

يعدّ اللجوء تقليدا من التقاليد العربية – الإسلامية 1، عرفه العرب قبل الإسلام، وكان واحدا من تقاليدهم المشهورة كالكرم وحسن الضيافة والفروسية. وجاء الإسلام ليؤكد على ضرورة الهجرة والخروج بحثا عن ملجأ أو ملاذ في حال وقوع الظلم والاضطهاد. وصاغ الفقهاء مجموعة من القواعد في الفقه الإسلامي فيما يتعلق باللجوء وأشكاله وقواعده، وبحقوق اللاجئين وواجباتهم 2.

Human Dignity and War: the Islamic Perspective

The protection of human life and respect for human dignity are the basis of the teachings of Muslim religion.

War, which threatens this life, and practices that interfere with this dignity, are forbidden by rules of Muslim Law or the Shari'a.

We will begin our report with a general presentation of the rules of Muslim Law or the Shari'a (I). Then, recalling the rules of this Law we will consider the categories of different countries in Muslim Law (II), looking in particular at rules forbidding interference with human dignity (III). Finally we will provide a practical example of respect for human dignity in action through articles from 1990 Cairo Declaration on Human Rights in Islam (IV).

Religion and the law in Syria

There is a common denominator between law and religion: The idea of a norm. Religion defined as an obligation ensuing from a contract with God, is the group of norms which govern the relationship between mankind and God. Law is the set of rules which govern the relationship between the people. The study of the relationship between law and religion could be done by the scholar from different angles, probably the most interesting for a jurists, is to study to what extent does religion influence the law and whether religion form a source of the law.

La valeur des instruments internationaux vis-à-vis du droit interne des États de l’Orient arabe

L’efficacité des traités internationaux dépend de leur valeur vis-à-vis du droit interne, c'est-à-dire de la supériorité de leurs normes en cas de conflit avec les dispositions de l’ordre juridique interne. Le droit international prévoit qu’aucun membre d’un traité ne peut invoquer les dispositions de son droit interne pour justifier la non-application de dispositions dudit traité. Ce principe est confirmé par la doctrine de la Cour Permanente de Justice Internationale (CPJI), dans deux avis consultatifs.

Le mouvement du panislamisme: son origine, son développement, et la création de l’Organisation de la Conférence Islamique

Divers mouvements : politique, religieux, social etc., ont marqué l’histoire des musulmans à la fin du XIXème siècle et au début du XXème siècle. Un parmi eux était le mouvement du « Panislamisme »1.

Nous allons définir, premièrement, le « panislamisme » (I), voir ses origines (II), examiner son développement dans la seconde moitié du XXème siècle, et enfin la concrétisation actuelle du panislamisme dans la création de l’Organisation de la Conférence Islamique (ci-après O.C.I.) (III).

The Enforcement Mechanisms of the Arab Charter on Human Rights and the Need for an Arab Court of Human Rights

All the regional Organisations adopted regional instruments for the protection of human rights: there are the European Convention on Human Rights 1950, the American Convention on Human Rights 1969 and the African Charter on Human and Peoples' Rights 1981. Only on September 15, 1994, the Council of the League adopted the first version of the Arab Charter on Human Rights. However on May 2004, the Arab Summit in Tunisia adopted a new version of the Arab Charter on Human Rights.

La liberté religieuse en tant que droit de l'Homme dans l'Islam

La "Liberté" est une des caractéristiques des droits de l'homme en Islam. Les autres caractéristiques sont: l'égalité et la justice.

Pour les croyants, la soumission à Dieu est une libération de l'être humain vis-à-vis de ses semblables, et d'autres soumissions qui peuvent porter atteinte à sa dignité et à sa personnalité. C'est d'abord, une "libération spirituelle" qui est traduite, ensuite, par une capacité de choisir, compte tenu de ce que Dieu nous a dotés de raison et de la possibilité d'agir selon notre choix.

La liberté religieuse est un composant essentiel de la liberté en Islam. Et, cette liberté est reconnue, garantie et défendue par les deux sources principales de la Charria ou le droit musulman, à savoir: le Coran (I), et la Sunna ou la tradition du Prophète Muhammad (II). Il n'en reste pas moins qu'il y a quelques sujets délicats liés à la liberté religieuse en Islam (III). Enfin, quelques textes adoptés par les organisations islamiques traitent de la liberté religieuse (IV).

Nous assistons, surtout en cette première décennie du troisième millénaire, à des développements importants et significatifs de l'histoire de l'Organisation de la Conférence islamique (O.C.I.)1

Nous allons analyser, dans cet article, les déclarations, les décisions et les communiqués finaux des différents Sommets islamiques de l'O.C.I. qui sont à la base des récents développements en faveur du respect des droits de l'homme, et qui ont été adoptés surtout par deux derniers Sommets islamiques, à savoir: le Sommet islamique exceptionnel de la Mecque (Arabie saoudite) de 2005 (I), et le 11e Sommet islamique ordinaire de Dakar (Sénégal) de 2008 (II).
